KABOOKI Terms and Conditions apply when you buy goods on www.kabooki.com. Read them carefully before you order.

1. General information

If there are parts of the Terms and Conditions (hereinafter terms) that you do not understand we suggest that you contact our customer service before shopping on this website.

The purchase contract may only be concluded in English.

2. IMPORTANT Notice

Our terms may be updated from time to time without notice (for example to reflect changes in technology, our business model, our system capacity or in relevant laws and regulations). Therefore, we ask you to accept the terms every time you shop with us. If you do not accept the terms, you cannot order goods from the website. The version on the website will be the applying version at any time.

Any reference to “you” or “your” means you as a user of the website, any reference to “we”, “us” or “our” means KABOOKI.

You have the right to withdraw from this contract without giving any reason within 14 days after the date on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods. Read more under section 5 Right of Withdrawal.

The rules on lack of conformity in the Danish Sale of Goods Act apply to your purchase, which means you have certain statutory warranties for the good’s conformity with the contract. Read more under section 6 Complaints.

Ordering

The online shop is open 24 hours a day but may be closed due to maintenance services.

You must be at least 18 years old and possess a valid credit card that is accepted by us (see Payment and Means of Payment) to purchase goods on the website.

We can only process your order if the delivery address is a residential or business address in one of the countries listed in the country dropdown on the website.

Among other things, we reserve the right to cancel the contract of purchase in one of the following situations, without being liable for compensation or other costs:

  • Your payment details are incorrect or cannot be verified
  • Your order is placed with the purpose of committing fraud or placed in connection with a criminal offense or other unlawful activities
  • There is an inadvertent error on the website, such as a payment error or the like
  • We have reasons to believe that you are under the age of 18

Contracts of purchase can only be concluded on the website. We do not process orders made in  emails, letters, faxes or by phonecalls.

When are you bound by your order?

Before submitting the order, you have the option of changing the information that you have provided, including delivery, billing, or payment information. Furthermore, you have the option of making changes to your order or to remove goods from your basket.

When you click "Place order" and the receipt appears on your screen, you are bound by the contract of purchase. Please read more under section 5 Right of Withdrawal.

If you made a mistake while pacing your order, please contact our customer service. They are always ready to help you.

After the conclusion of the contract, the provisions in section 5 Right of Withdrawal apply.

Access to the contract

You will receive a confirmation of the content of the contract of purchase and a copy of these terms via email.

We store concluded contracts, including the order confirmation, for a certain amount of time. We recommend that you save these documents as well.

Measures against fraud

In order to protect you against fraud and maintain a high level of security for online purchases, we may carry out verification checks. The check may comprise the data that you send when ordering, including your address and payment information.

3. Payment and Means of Payment

We accept the following means of payment:

If you pay by credit card, you will be asked to enter the card's three-digit security code. You will find this code on the back of your card, usually on the right side. The security code is necessary for the payment to be processed and for maintaining a high level of security for online purchases. There may also be other similar safeguards.

Payment procedure

Once your goods leave our warehouse to be delivered, your payment will be drawn on the payment service selected by you.

If you have ordered more items, and one or more of these are out of stock, we of course only draw payment for the items we deliver.

4. Prices and delivery

Prices

The prices of the items on the website are listed without delivery costs. Costs relating to delivery, freight or postage may vary and are added to each order.

All the listed prices for goods, delivery costs and other costs include taxes and value-added taxes.

The prices on the website are shown in the currency applicable in your country. Your delivery address determines the applicable currency. Please note that a change of country of delivery may influence the price and delivery costs.

You can pay in the following currencies:

Delivery costs

Free delivery
If you purchase exceeds EUR 100 / GBP 75 you get a free delivery (to the countries we deliver to, please see below).   

Austria
Delivery cost for delivery to your home address for orders not exceeding EUR 100 is EUR 9.

The Netherlands and Belgium
Delivery cost for delivery to your home address for orders not exceeding EUR 100 is EUR 9.

Ireland, Finland, France, Portugal, Italy and Spain
Delivery cost for delivery to your home address for orders not exceeding EUR 100 is EUR 12.

Delivery terms

We only deliver to residential and business addresses and to delivery spots. Our normal delivery time is 2-8 days, depending on the country to which the delivery takes place.

Goods will be delivered to the delivery address specified in the order unless you chose delivery to a delivery spot.

Your goods will be delivered Monday to Friday. The time of delivery depends on the country in which the delivery takes place and the carrier used.

The goods must be signed for upon receipt. It does not necessarily need to be signed by you. People at the delivery address (except the carrier) may sign for the receipt with binding effect on you.

Our carrier will make at least two delivery attempts. At each delivery attempt, the carrier will leave a receipt which informs you about the details of the next delivery attempt and the possibility of a self-pickup. The carrier will usually keep the goods for up to 7 days before returning them to us as undelivered. Please note that our carrier can also deliver the goods to your neighbour if you have given your consent to this and if the circumstances allow it.

Please note that the risk of loss of or damage to the goods passes to you after delivery. If the package appears to be damaged, you should refuse to receive the goods.

If you wish to complain about any non-conformity, you are required to give notice to us. Please read more under section 6 Complaints.

5. Right of withdrawal

You have the right to withdraw from this contract without giving any reason within 14 days.

If you have purchased more items in one order you can choose to withdraw from the contract regarding the purchase of some or all goods.

The withdrawal period will expire 14 days after the date on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods. If the period ends on a public Danish holiday or a weekend the period is extended to the following business day.

Exercising the Right of Withdrawal

To exercise the right of withdrawal, you must inform us about your decision to withdraw from the contract by an unequivocal statement (e.g. by email or by the return form which is sent to you together with your order).

In contrary, you cannot withdraw from the contract by refusing to receive your package or by not picking up the package without informing us about your withdrawal.

You can use the standard withdrawal form in the bottom of this page, but this is not mandatory. The standard withdrawal form is sent by email to you together with these terms.

The withdrawal deadline is met if you send your notice of withdrawal before the withdrawal period has expired.

Returning your purchase and return costs

If you want to withdraw from the contract of purchase, you must send back the goods to our address (we do not pick up packages at delivery points) or hand them over to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

The return shipping costs will be borne by you. When returning products, we kindly ask you to fill in the return. Please provide the following info: your name and invoice number. If you do not have the return form, you may print it from the bottom of this page.

We recommend that you save the post office receipt as proof of your delivery of the package to the post office/carrier.

If you want to change the goods to other items, we kindly ask you to return the goods and order the new items on the website.

Effects of withdrawal

If you withdraw from the contract of purchase, we shall reimburse to you all payments received from you, including the costs of delivery. However, it does not apply in the following cases:

  • If you have purchased more items in one order, and you only want to withdraw from a part of your purchase. In such a case we do not reimburse the delivery costs.
  • If you have chosen a delivery form that is more expensive than the cheapest delivery form we offer, we only reimburse you for the cheapest delivery form.

We reimburse to you the amount without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

We will carry out such reimbursement using the same means of payments as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees because of such reimbursement.

Trying the product and packaging

You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. This means that you can try the product like you can do in a store, but you cannot start using the product.

If you have been using the product in a way, you are not allowed to in a store, and we cannot sell the product again, we will deduct the depreciation in the amount we will reimburse you. If the product no longer has a commercial value, we will not reimburse you the purchase money.

You must return the products in their original packaging.

Furthermore, when returning the goods, they must be defensible packed. You are liable for the goods until we receive them. Therefore, please save the post office receipt and the track and trace number.

6. Complaints – Non-Conforming and Incorrect Goods

When purchasing goods from the website the Danish Sale of Goods Act apply why you, as a consumer, have the right to complain for 24 months.

If your goods are non-conforming or we have delivered the incorrect goods, please contact our customer service within reasonable time. We recommend that you contact our customer service as soon as possible, notably if the goods have damages due to the transport. If you complain within 2 months after you have noticed the non-conformity it will always be within reasonable time.

If you notice the non-conformity or incorrect goods at the time of delivery, you should refuse to receive the goods.

If your complaint is legitimate, you can choose between the following options:

  • You can return the goods and we will reimburse you the purchase price and delivery costs
  • You can return the goods and order a similar product, provided we can deliver a similar product

When you contact customer service, please inform us in detail about the non-conformity and the order number and potential item numbers. You can also use the return form, which you can download in the bottom of this page, but it is not mandatory. It only makes it easier for us and reduces the time of expedition.

Furthermore, when returning the goods, they must be defensible packed. You are liable for the goods until we receive them. Therefore, please save the post office receipt and the track and trace number.

7. Your Right to Complain

You are always welcome to contact our customer service, if you wish to complain regarding goods purchased on the website.

You may also use the European Commission online complaints register when submitting your complaint. This is particularly relevant if you are a consumer residing in another EU country. You may submit the complaint by using the following link. When submitting the complaint, you must state our email address support@kabooki.com.

8. Other Matters

Updating the website

We do our best to update the website and to ensure that prices, offers, descriptions and other information concerning the goods are correct. Typographical errors and errors in prices, offers, descriptions and other information concerning the goods may occur, and sometimes we discover that the prices on goods are incorrect. We express reservations to products out of stock, as updating or maintaining our systems.

If an error is apparent to the consumer, we can claim withdrawal from the contract.

Force majeure

We are not responsible for delays or failure to meet our obligations in relation to these terms if the delay or the non-compliance is due to events beyond our control.

The completeness of the contract

These terms constitute the complete terms of the contract between the website and you as a consumer.

Invalidity

If one or more of the provisions in the terms are declared fully or partially invalid, the remaining provisions still apply.

Assignment

We are entitled to assign our rights and obligations under the contract with you to third parties. The standard of the service you receive will not be impaired by the assignment. We will notify you of such possible assignment. By accepting these conditions, you consent to any such future assignment. At the same time, you agree that from the time when we have given you notification of the assignment, your rights may be claimed only against the third party in question.

We treat your personal data confidentially.  Please read our privacy policy, that explains how we use the personal data that you provide in connection with the ordering procedure. Choice of law and jurisdiction

Any contracts concluded between us using these terms are governed by Danish law. Any dispute which may arise in connection with our contract, including its existing or validity, must be brought before a competent court in Denmark.
